January 13, 2006:

Nevada's seniors and the working uninsured scored a victory yesterday when the State Board of Pharmacy voted to move ahead with the importation of Canadian drugs.

The ability to purchase safe and effective drugs at a reasonable price will help maintain the health and well-being of all Nevadans, and I am pleased that I was able to play a role in ensuring this much needed program moves forward.

As many of you may recall, AB195 was introduced during the 2005 legislative session. To move the bill through the Senate, I offered an amendment that would strengthen the safeguards against counterfeit drugs. The bill was re-introduced as SB5 during the short special session and passed both houses. The pharmacy board quickly began the regulatory process necessary to implement the program and inspected several pharmacies in Canada. Prior to full implementation, however, the State Attorney General rendered an opinion that the law as passed by the legislature was "unworkable" and that the pharmacy board should not move forward with the program.

Quickly, the proponents of the bill began an effort to fully explain the true intent of the bill to the AG and the Board. These efforts culminated at the Board meeting yesterday where I presented testimony, along with other legislators and representatives on behalf of seniors and the medical community, on the importance of this program.

Fortunately, the Board of Pharmacy took the high road and in a bold move voted to implement the legislation through the regulatory process. Hopefully, the approved pharmacies will be posted on the Consumer Advocate's website within 90 days.
